Hearth Tarbert speaks about Ether in Yahoo! Finance All Markets Summit
The chairman of the United States Commodity Futures Trading Commission (CFTC) revealed his opinion about Ethereum(ETH) at the All Markets Summit on Oct. 10. Hearth Tarbert, chairman of CFTC, claimed Ether is a commodity, and so ETH futures trading is possible and it falls under the jurisdiction of the Commission.
Tarbert said "We've been very clear on bitcoin: bitcoin is a commodity. We haven't said anything about ether- until now - it is my view as chairman of the CFTC that ether is a commodity." during Yahoo! Finance interview.
He also said that there is legal ambiguity in the cryptocurrency, especially altcoin, but similar digital assets should be treated similarly,” referring specifically to “forked assets”, or cryptocurrencies that are created as the result of software upgrades on cryptocurrency networks. “If the original digital asset hasn’t been determined to be a security and is, therefore, a commodity, most likely the forked asset will be the same – unless the fork itself raises some securities law issues under that classic Howey Test,” Tarbert said, implying that the CFTC’s classification of a cryptocurrency depends on how a coin is created. For example, Bitcoin Cash(BCH) which is derived from Bitcoin should be treated the same as the original asset.
